This Legal Notice provides the information required by Article 5 of Law no. 365/2002 on electronic commerce, by Article 74 of Company Law no. 31/1990, and by Government Emergency Ordinance no. 34/2014 on distance contracts. It also sets out the terms on which the content of our websites is made available.
It applies to sungrid-portal.io, codershyve.com and codeops.ro, and to any subdomain of those websites operated by us.

Correspondence in writing should be sent to the registered office or to office@codershyve.com. E-mail is our preferred and fastest channel.
2. Nature of our activity, and what we are not
We develop and license software for the monitoring, visualisation and optimisation of energy installations, and we provide technical support for that software.
For the avoidance of doubt, and because our software is used in the energy sector, we state expressly that we are not, and do not hold ourselves out as:
- an electricity supplier, producer, aggregator, balancing responsible party or trader;
- a distribution or transmission system operator;
- an entity licensed or authorised by the Romanian Energy Regulatory Authority (ANRE) or by any equivalent regulator in another country;
- an authorised electrician, electrical designer, electrical verifier or commissioning body;
- a notified body, certification body or testing laboratory;
- an investment firm, financial adviser, insurance intermediary, tax adviser or law firm;
- a provider of metrologically certified measuring instruments or of measurements valid for settlement or billing purposes.
Our activity is not subject to a prior authorisation scheme within the meaning of Article 5(1)(e) of Law no. 365/2002. We do not exercise a regulated profession, and no professional body governs our activity.
3. Hosting and technical providers
Our online store is hosted on the Shopify platform, operated by Shopify International Limited, Ireland, and Shopify Inc., Canada. Other websites and services we operate may be hosted with other providers within the European Union. Details of the providers who process personal data on our behalf are given in our Privacy Policy.
4. Intellectual property in our content
Unless otherwise indicated, all content on our websites — including text, structure, layout, graphics, icons, illustrations, diagrams, photographs, videos, user interface designs, software, source code, object code, container images, documentation, database structures and their selection and arrangement — is owned by or licensed to S.C. Codershyve S.R.L. and is protected by Law no. 8/1996 on copyright and related rights, by Directive 2001/29/EC and Directive 96/9/EC, and by international copyright treaties.

You may view our websites and print or download extracts for your own personal or internal business reference only. You may not otherwise reproduce, distribute, publicly communicate, adapt, translate, rent, lend or make available our content, in whole or in part, without our prior written consent.
Quotation for the purposes of criticism, review, news reporting, teaching or scientific research is permitted to the extent allowed by law, provided the source and our name are clearly indicated.
Rights in the software itself are governed by our Terms of Service and by any applicable End User Licence Agreement, not by this Notice.
5. Trade marks
“SunGrid Portal”, “Codershyve”, “CodeOps”, our logos and our product names are trade marks or unregistered marks of S.C. Codershyve S.R.L. Nothing on our websites grants any licence or right to use them. Use of our marks without our prior written consent is prohibited, save for descriptive references permitted by law.
6. Third-party names, marks and logos — no affiliation
This Section is important. Please read it.
Our software is designed to interoperate with equipment and services made by third parties. Their names, model designations and logos may appear on our websites, in our documentation and within the software interface — for example the names and logos of inverter, battery, gateway, meter and smart-device manufacturers, and of cloud and forecast services.
- All such names, marks and logos remain the property of their respective owners.
- They are used solely for identification and descriptive purposes, to indicate which equipment or service a feature relates to or is compatible with. This is nominative use and does not assert any right in the mark.
- Their appearance does not imply any affiliation, partnership, sponsorship, endorsement, certification, approval or authorisation by the owner of the mark, nor any statement that we are an authorised dealer, integrator or service partner, unless we say so expressly and in writing.
- A statement that our software supports or is compatible with a device is a statement about our software. It is not a warranty given by the manufacturer, and it does not extend, alter or affect any warranty, certification or approval issued by that manufacturer.
- Compatibility may change without notice if a manufacturer alters its firmware, protocol, register map or interface. We are not responsible for such changes.
If you are the owner of a mark and object to the way it appears on our websites or in our software, contact us at office@codershyve.com and we will review the matter promptly.
7. Open source and third-party components
Our software incorporates open source and other third-party components, each licensed under its own terms. Those terms govern the component concerned and prevail over this Notice in respect of it. Copyright and licence notices for those components are preserved in the distribution. A list of components and their licences is available on request at office@codershyve.com.
8. Accuracy of content, and no advice
We take reasonable care to ensure that the content of our websites is accurate and up to date. Nevertheless, content is provided for general information only, may contain errors or omissions, may become out of date, and is subject to change without notice.
Nothing on our websites constitutes, or is to be relied on as:
- engineering, electrical or design advice, or a substitute for the judgement of a qualified engineer or authorised electrician;
- a recommendation or instruction as to how any installation, inverter, battery or protection device should be sized, configured, operated or protected;
- financial, investment, tax, accounting, insurance or legal advice, or any projection of savings, payback, yield or return that you may rely on;
- a representation about regulatory compliance, grid code conformity, permitting or eligibility for any subsidy, tariff or support scheme in any country.
You must obtain independent professional advice before acting on anything published on our websites. To the fullest extent permitted by law, we accept no liability for any action taken or not taken in reliance on our website content.
9. Technical figures, performance data and calculations
Any performance figure, energy yield, saving, efficiency, response time, capacity or financial result shown on our websites or in demonstrations is indicative and illustrative. It is derived from particular assumptions, equipment, tariffs, weather data and site conditions that will not match yours.
Forecasts, optimisations, economic calculations and simulations produced by our software are estimates. They depend on third-party data sources, on the accuracy of the configuration entered by the operator, and on conditions outside our control. They are not guaranteed, and no result of any kind is warranted.
10. Statements about future development
Descriptions of planned features, roadmaps, releases, integrations or timelines are statements of current intention only. They are not commitments, do not form part of any contract, and may change or be abandoned at any time without notice. Purchase decisions should be based on the functionality that exists at the time of purchase, not on anything planned.
11. Screenshots, demonstrations and sample data
Screenshots, dashboards, demonstration environments and sample datasets shown on our websites use illustrative or anonymised data. They do not represent real customer installations, real consumption, real prices or real financial outcomes, and they must not be relied on as evidence of achievable results.
12. Links to third-party websites
Our websites may contain links to websites operated by others. Those links are provided for convenience only. We do not control those websites, do not endorse them or their content, and are not responsible for their availability, accuracy, security, lawfulness or privacy practices. Following an external link is at your own risk and is governed by the terms of the site you reach.
You may link to the home page of our websites in a fair and lawful way that does not damage our reputation or take advantage of it. You must not frame our content, present it as your own, or suggest any association or endorsement that does not exist. We may withdraw permission to link at any time.
13. Availability and security of the websites
Our websites are provided on a reasonable-endeavours basis. We do not warrant that they will be available without interruption, free of error, or free of viruses or other harmful components. Access may be suspended, withdrawn or restricted at any time, including for maintenance.
You are responsible for configuring your own equipment and for using your own virus protection. You must not misuse our websites by introducing malware, attempting unauthorised access, or interfering with their operation. Such conduct may constitute a criminal offence under the Romanian Criminal Code, and we will report it to the competent authorities and cooperate with them.
14. Responsible disclosure of security vulnerabilities
We welcome reports of security vulnerabilities in our websites or software. Please report them privately to office@codershyve.com with enough detail to reproduce the issue, and allow us a reasonable period to remedy it before any public disclosure.
If you act in good faith, report privately, do not access, modify, exfiltrate or destroy data belonging to us or to others, do not degrade our services, and do not use the finding for gain or extortion, we will not pursue legal action against you in respect of the research itself, and we will credit you if you wish. We do not operate a paid bug bounty programme, and no reward is offered or implied.
15. Reporting unlawful or infringing content
If you believe that content published on our websites infringes your rights or is otherwise unlawful, notify us at office@codershyve.com, stating your name and contact details, identifying the content and its exact location, explaining the legal basis of your objection, and confirming in good faith that your notification is accurate.
We will examine the notification promptly, remove or disable access to content where the objection is well founded, and inform you of the outcome. This procedure does not affect any other remedy available to you.
16. Reservation of rights against automated extraction
We expressly reserve all rights in the content of our websites against text and data mining, scraping, harvesting and automated extraction, including for the purposes of developing or training artificial intelligence models. This constitutes an express reservation of rights within the meaning of Article 4(3) of Directive (EU) 2019/790 on copyright in the Digital Single Market, as transposed into Romanian law.
Accordingly, no exception for text and data mining applies to our content, and any such use requires our prior written consent. Automated access that ignores this reservation, or that ignores the directives published in our robots.txt, is unauthorised.
17. Personal data and cookies
How we handle personal data is described in our Privacy Policy, which sets out, among other things, who acts as controller for which data, the legal bases we rely on, retention periods, recipients, international transfers, and how to exercise your rights, including your right to complain to the Romanian National Supervisory Authority for Personal Data Processing (ANSPDCP).
Cookies and equivalent technologies are described in Section 12 of that Policy. Non-essential cookies are set only with your consent, which you may withdraw at any time.
18. Consumer information and dispute resolution
- Sales are governed by our Terms of Service, our Return and Refund Policy and our Delivery Policy.
- Complaints should be addressed first to office@codershyve.com. We aim to respond within 30 calendar days.
- Consumers may also complain to the Romanian National Authority for Consumer Protection (ANPC), anpc.ro, or to the equivalent authority in their country of residence.
- Consumers may use an alternative dispute resolution entity under Government Ordinance no. 38/2015. We are not obliged to participate and decide on a case-by-case basis.
- The European Commission's online dispute resolution platform ceased operating on 20 July 2025 following Regulation (EU) 2024/3228 and is therefore no longer available. Any link to it elsewhere is obsolete.
19. Limitation of liability in respect of our websites
To the fullest extent permitted by law, we exclude liability for any loss or damage arising from your use of, or inability to use, our websites, or from reliance on their content, including loss of profit, revenue, savings, business, data or goodwill, and any indirect or consequential loss.
Liability arising from the purchase and use of our software, licences, subscriptions and support is governed by Sections 18 and 19 of our Terms of Service, including the aggregate cap set out there, and not by this Notice.
Nothing in this Notice excludes or limits our liability for death or personal injury caused by our negligence, damage caused intentionally or by gross negligence within the meaning of Article 1355(1) of the Romanian Civil Code, fraud or fraudulent misrepresentation, liability under the product liability regime, the statutory rights of consumers, or any other liability that cannot lawfully be excluded.
20. Governing law and jurisdiction
This Notice and any non-contractual obligation arising from it are governed by Romanian law. Disputes are subject to the jurisdiction of the competent courts of Baia Mare, Romania.
Where you are a consumer, this does not deprive you of the protection of the mandatory provisions of the law of your country of habitual residence, nor of your right under Articles 17 to 19 of Regulation (EU) No 1215/2012 to bring proceedings in the courts of your own domicile.
21. Language
The authoritative version of this Notice is the English version. Any translation is provided for convenience only, except where mandatory consumer law requires a translation to prevail, in which case it prevails to that extent.
22. Severability
If any provision of this Notice is held invalid or unenforceable, it is severed or reduced to the minimum extent necessary and the remaining provisions continue in full force.
23. Changes to this Notice
We may update this Notice at any time. The version in force is the one published on our websites, and the effective date above reflects the latest revision.
